End User Licence Agreement

1. What this document is

This is an agreement between you and the licensor about the terms on which you use vpsFocus — the desktop application and the services that go with it. By installing the software or creating an account you accept these terms. If you do not accept them, do not install and do not use it.

2. What you may do

You are granted a non-exclusive, non-transferable right to use the software for its purpose: to deploy the monitoring stack on servers you lawfully have access to, and to work with the data it collects.

The right lasts as long as your account does, applies worldwide, and requires no payment beyond your chosen plan.

3. What you may not do

• Deploy the stack on servers you accessed without the owner's permission.
• Circumvent plan limits, including by modifying the software.
• Present the software as your own work or resell it as your own product.
• Use the software for anything unlawful in the applicable jurisdiction.

4. No warranty

This is not boilerplate. It follows directly from what the product does: the software performs actions on servers that are not yours and that you do not fully control. Provisioning changes the state of a server — it installs Docker, starts containers, issues a certificate, and takes ports 80 and 443.

The software is built to reduce that risk: the mandatory readiness check leaves not a single file on the server, a failed first install is rolled back automatically, existing web servers and busy ports are never touched, and the stack is isolated in its own Docker network. The risk cannot be removed entirely, and the decision to install on a particular server remains yours.

5. Limitation of liability

To the extent permitted by applicable law, the licensor is not liable for lost profits, lost data, site downtime, damage to business reputation, or other indirect losses arising from use of the software.

In any event, the licensor's total liability is limited to the amount you actually paid for the software during the [PERIOD] preceding the event.

6. Your data and your clients' data

Visitor analytics, server metrics and everything else the stack collects stay on your clients' servers and are not sent to the licensor. Secrets — SSH keys, passwords, passphrases, and the credentials generated during provisioning — stay in your operating system's credential store and go nowhere.

The Mail feature works the same way: it calls a client's own Cloudflare account directly, with an API key that stays in your credential store and is never sent to the licensor. The licensor does not host, read or store that mail, and has no access to the Cloudflare account it moves through — responsibility for the mail addresses you create and for the Cloudflare account they live in rests with you and your client, the same as for a server.

What does reach the licensor's server is described in the privacy policy.

Responsibility for the lawfulness of processing your clients' visitors' data rests with you and your clients: the server that data sits on is yours, not ours.

7. Updates

The software can update itself. Updates are verified against a cryptographic signature: an unsigned update, or one signed with the wrong key, is refused. You may turn updates off, but the licensor does not support outdated versions and does not guarantee that they will keep working with the service.

8. Open source components

The deployed stack consists of third-party open source software distributed under its own licences. Those licences govern the corresponding components independently of this agreement.

9. Termination

You may end this agreement at any time by deleting your account and the software. The licensor may end it in case of a material breach — above all, using the software on other people's servers without permission.

After termination, a stack already deployed on your servers keeps running: it does not need to reach the licensor. What stops working is bundle updates, plan checks, and any feature that runs on the licensor's infrastructure.

10. Governing law and disputes

This agreement is governed by the law of [JURISDICTION]. Disputes are resolved [DISPUTE RESOLUTION].

11. Changes

The licensor may change this agreement. Material changes are announced to the account's email address at least [NOTICE PERIOD] before they take effect. Continuing to use the software after that date means you accept them.
